General

“StMartinbookings.com” means the domain name used under license by Island Bookings B.V., a registered company in the Netherlands. StMartinbookings.com acts as a booking agent for booking ferry crossings and fast boat transfers, hotels and other services on the website www.StMartinbookings.com (the “Site”).

By using and/or visiting the Site for making fast ferry bookings you agree to these General Terms and Conditions, the Privacy Policy and the Terms of Use and Site Use (“the Terms”) and you expressly consent and agree to be bound by the Terms and all applicable laws and regulations that govern this Site and your booking.

As we are an affiliate of Agoda.com and Booking.com, for Hotel bookings please refer to their Terms and Conditions, Privacy Statement and any other information on their respective websites.

References to “accommodation providers” means the owner/providers of the hotels, apartments, villas and other accommodation of any description featured on this website and “accommodation” means the accommodation including all facilities and services advertised on the Site.

References to “other service providers” or “other services” means the owner/providers of the fast ferry companies, whose tickets are available on this site, as well as the owner/provider of diving centres and other providers of tourist activities and/or services that are advertised on this site.

Important Information

StMartinbookings.com acts as a booking agent only in respect of all bookings made on StMartinbookings.com. StMartinbookings.com has entered into contracts with the service providers on our website. These contracts ensure that the service providers will act in the best possible way towards the customers of StMartinbookings.com. This means that in the unlikely event there is a problem with a customer’s booking, e.g. Hotel overbooking, or a mechanical problem with a ferry, the service provider will seek to resolve the situation to the customer’s satisfaction at no added cost to the customer i.e. sourcing a room of equal standard in a suitable location, or arranging another boat to transport the passengers. In the unlikely event that the service provider cannot fulfil the customers’ requirements, please contact us.

StMartinbookings.com undertakes no responsibility for, and is not liable for, the misrepresentations, breaches of contract, breaches of statutory duty or negligence of any of the accommodation providers and other suppliers of services whose products and services are sold through us. This means that in the event of you suffering personal injury, illness or death as a result of any act or omission of an accommodation provider or other supplier of services (or their employees or agents) or you having any complaint about the quality of the services provided or having any other complaint at all, your sole right of redress will be against the independent third party who provided such service and StMartinbookings.com will be under no liability at all (whether in contract, tort or otherwise howsoever).

You accept that StMartinbookings.com has not in any way selected or assembled your travel arrangements for you. Your accommodation and travel arrangements and other services are not a package and do not fall within the meaning of The Package Travel, Package Holidays and Package Tours Regulations 1992.

By proceeding to book fast ferry services through the Site, you accept and understand that ferry schedules are subject to change without prior notice. For your comfort and safety, ferry operators and other service providers may be forced to cancel their services at short notice due to changing weather/sea conditions, or mechanical problems with their vessels. Although this is a very rare occurrence, you must be aware that neither StMartinbookings.com, nor the ferry operators or other service providers, will be liable for cancellation fees or any other additional expenses incurred due to a cancellation of service. We therefore strongly recommend that you obtain travel insurance (prior to your trip) for your own protection.
By proceeding to book accommodation and/or other services through the Site, you accept that you will indirectly be entering into a contract with the accommodation and /or other service providers and therefore any claims or complaints should be made directly with the accommodation and /or service provider. In the event of any claims or complaints please also contact us at [email protected].

You understand that StMartinbookings.com may not have conducted any quality or other checks on the accommodation providers or other service providers and StMartinbookings.com makes no representations about the suitability of the accommodation and/or services offered for sale through the Site. The inclusion or offering for sale of an accommodation and/or services by StMartinbookings.com does not constitute an express or implied endorsement or recommendation by StMartinbookings.com of such accommodation or services. StMartinbookings.com does not guarantee the accuracy of, and disclaim liability for any inaccuracies relating to the accommodation and other services offered for sale through us.

Nothing in these terms of use shall operate to exclude or limit the liability of StMartinbookings.com for fraudulent misrepresentation or death or personal injury caused by our negligence.

Where you, or any of the people that you are booking on behalf of, are in breach of any of the provisions of these Terms or contravention of any laws or rights of a third party, StMartinbookings.com reserves the right to cancel your booking without refund or compensation in any way and recover from you any costs incurred as a result of your behaviour.

If you Cancel, Amend or Change a booking


For changes to VOYAGER FERRY tickets:

DATE/TIME CHANGES

  • For ECONOMY CLASS: For any DATE and/or TIMING changes to bookings with VOYAGER FERRY, made before departure, a fee of EUR 9 per person, per ticket, will be payable directly to VOYAGER FERRY at the time of making the change.
    Should the new date/time not be known, tickets can be changed to OPEN DATED - valid for travel within 12 months of the original departure date - for a fee of EUR 29 per person, per ticket.
  • For SMART CLASS and BUSINESS CLASSDATE and/or TIMING changes to bookings with VOYAGER FERRY, made before departure, are possible free of charge. 
    Should the new date/time not be known, tickets can be changed to OPEN DATED - valid for travel within 12 months of the original departure date - for a fee of EUR 20 per person, per ticket.

Since the fee is payable directly to Voyager Ferry, you must contact them for changes to your reservation; StMartinbookings.com will not be able to assit you with amending your Voyager Ferry booking.

For changes to GREAT BAY EXPRESS tickets:

DATE/TIME CHANGES

  •  A request to change the DATE and/or TIME can be made ONLY ONCE, up to 24 hours before departure, free of charge.
    Such requests must be submitted in writing and are always subject to availability.
  • Any further date/time changes can only be made on the day of travel, in person at the Great Bay Express office, subject always to availability.
  • Tickets remain valid for travel up to 1 YEAR from the original first departure date.

For ALL OTHER ferry companies, you may modify the departure date and/or time of your ferry booking up to 24 hours before departure, without penalty. Should a change in travel dates result in a higher price category or more expensive period/season, you will only be charged the difference in fare. Within 24 hours of departure, dates/times may only be changed once at the discretion of the ferry company, who may levy a penalty fee. Additional changes will be considered a cancellation and subject to a 100% cancellation fee. All date/time changes are subject to availability. For booking cancellations, see Cancellation Policy below.

For ferry bookings and any other service providers, you may contact them directly. Contact information will be detailed either on your e-ticket and/or in the confirmation email you will receive immediately after you make a booking through the Site. For accommodation bookings see the Terms and Conditions on www.agoda.com or www.booking.com. If you amend your booking, there may be an amendment fee levied by the accommodation or other service provider. In any event, if you fail to amend your booking in accordance with the provider's amendment policy, you may be charged an amendment fee by the accommodation or other service provider.

 

Cancellation Policy

For accommodation bookings please refer to the cancellation policies detailed on www.agoda.com or www.booking.com, depending on which affiliate partner you have booked your accommodation through.

VOYAGER FERRY - the following strict cancellation conditions apply immediately after booking:

ECONOMY Class  = 100% NON-REFUNDBALE at all times
SMART Class If cancelled more than 48 hours before first departure = 40% REFUNDABLE (minus any admin fees or charges applied to make the refund - see the general Terms and Conditions for cancellation charges)
If cancelled less than 48 hours before first departure = 100% NON-REFUNDBALE
BUSINESS Class If cancelled more than 48 hours before first departure = 60% REFUNDABLE (minus any admin fees or charges applied to make the refund - see the general Terms and Conditions for cancellation charges)
If cancelled less than 48 hours before first departure = 100% NON-REFUNDBALE
NO SHOW - or -
Cancellation after first departure
 = 100% NON-REFUNDBALE


DATE/TIME CHANGES:

In all cases, once boarding passes have been issued and/or travel has already commenced, tickets are 100% non-refundable; although it may still be possible to amend the date, subject always to availability and the applicable fee.

IMPORTANT: Voyager has a very strict cancellation policy, which they adhere to even if cancellation is due to sea/weather conditions, a medical/family emergency, not having a proof of a negative PCR test, or as a result of cancelled airline/accommodation reservations.


GREAT BAY EXPRESS - the following cancellation conditions apply immediately after booking:

  • ECONOMY CLASS = 100% NON-REFUNDABLE at all times!

Date/time changes are possible, subject to availability. Tickets are valid up to a maximum of 1 year from the original travel date.

Same-day Roundtrip tickets DO NOT allow an overnight stay. If you try to return on a different date, you will be charged an additional fare equivalent to the difference between the fare paid and the price of a regular Roundtrip. Failure to pay the applicable fare will result in boarding being denied, with no possibility of a refund.

IMPORTANT: Great Bay Express has a very strict cancellation policy, which they adhere to even if cancellation is due to sea/weather conditions, a medical/family emergency, or as a result of cancelled airline/accommodation reservations.

 


FUNTIME CHARTERS or CALYPSO CHARTERS  - the following cancellation conditions apply:

  • 100% refund if cancelled more than 2 weeks before departure
  • 50% refund if cancelled less than 2 weeks but more than 48 hours before departure
  • No refund if cancelled less than 48 hours before departure or for No-shows

THE EDGE - the following cancellation conditions apply:

  • 100% refund if cancelled more than 24 hours before departure
  • 50% refund if cancelled less than 24 hours before departure
  • No refund for No-shows

DISCLAIMER: Please note that schedules are subject to change or cancellation without notice. Should a trip be cancelled, the ferry operator will do their utmost to secure a seat for you on another vessel if available, on another day with their own vessel or a full refund will be issued. If the ferry is unable to travel due to weather or mechanical failure, you will be notified of this and can choose another day to travel, or receive a full refund. In all cases, neither The Edge Ferry, nor StMartinbookings.com, will be liable for any additional costs incurred, most especially at this point when these routes are new and transporting very small numbers. We regret the inconvenience to clients, it is without intention or negligence.


DAWN II - the following cancellation conditions apply:

  • 100% refund if cancelled more than 2 weeks before departure
  • 50% refund if cancelled less than 2 weeks but more than 48 hours before departure
  • No refund if cancelled less than 48 hours before departure or for No-shows


All refunds, once approved by the ferry operator or other service provider, will be paid directly from StMartinbookings.com, less any admin fees and/or charges applied to make the refund.

Where applicable, this cancellation policy overrides any of the ferry companies’ individual cancellation policies and all refunds will be made by StMartinbookings.com.

Should you fail to show up for a booked ferry service, accommodation booking, or any other booking with other service providers, you will be considered as a 'No-Show'. In such cases, where no prior notification to cancel (in accordance with the above cancellation policies) has been given to the service provider, No-Shows will be considered as cancellations for all service providers.

When notifying the ferry company or other service providers of a cancellation, please copy the email to [email protected] so that we can process your refund (if applicable). All necessary contact information is detailed on your e-ticket and/or in the email confirmation sent to you at the time of booking.

NOTE: If you are arriving or departing St Maarten on a cruise ship, no refunds will be given for cancellations due to the late arrival / early departure of your ship.

Payment

All ferry tickets are paid for in full on StMartinbookings.com. For hotel bookings, it depends on which of our affiliate partners' websites you use.
Agoda.com - you will be charged in full at the time of booking. For any changes, cancellations or refunds please refer to the Agoda.com terms and conditions.
Booking.com - you pay directly at the hotel. No booking fees/deposits are required to make a reservation; although a credit card number is necessary to make a reservation.

Site Content, Documentation and Booking information

StMartinbookings.com may modify the content of the Site and/or Terms at any time, and such modification shall be effective immediately upon posting of the modified content and/or Terms on the Site and your continued use of or access to this website will be deemed to indicate your acceptance of the modified content and/or Terms.

Any information placed on the Site relating to hotels or other service providers advertised on the Site including, but without limitation, details of the hotel/service provider, the facilities available, any accreditations afforded to the hotel and/or any details relating to any other services advertised on the Site have been provided by the accommodation and/or service providers who are independent businesses and are not agents or employees of StMartinbookings.com or its affiliates.

Such information does not constitute any advice or recommendation given by StMartinbookings.com and StMartinbookings.com shall not be held liable for inaccuracies or errors in the accommodation contents or any of its elements. These independent businesses provide the services in accordance with their own terms and conditions (excluding cancellations policy detailed herein) which may limit or exclude their liability to you.

StMartinbookings.com and its affiliates are not liable for any acts, omissions, breaches or negligence of any such independent businesses or any damages or expenses resulting from the aforesaid. StMartinbookings.com and its affiliates are not liable for any refunds in the event of overbooking or force majeure or any other cause beyond their control.

As StMartinbookings.com acts as a booking agent, StMartinbookings.com will have no responsibility for any errors in any documentation except where those errors were made by StMartinbookings.com.

Confirmation

To confirm a booking, you must be authorised to make the booking by all persons named on the booking and their parent or guardian for all party members who are under 18 years when the booking is made. By making the booking, you are confirming that all persons named on the booking accept the Terms and that you will inform the other persons named on the booking of the confirmation details and any other appropriate information. By making the booking you also become responsible for making all payments due under the booking.

You will receive an email confirmation or your bookings.

All accommodation bookings made through www.agoda.com require full payment at the time of booking in order to confirm a reservation. For accommodation bookings made through www.booking.com, no booking fees/deposits are required to make a confirmed reservation; although a credit card number is necessary to make a reservation.

Island Bookings B.V. will take full payment for ferry and fast boat transfer tickets booked through StMartinbookings.com.

Island Bookings B.V. will not take any payment for any diving services or any other services provided by other service providers.

Age and Responsibility

You warrant that you are 18 years of age or over and have the legal capacity to use the Site and to create a legally binding contract.

You warrant that all personal information submitted during the booking process is correct and you accept financial responsibility for all transactions made under your name or account.

You hereby authorise StMartinbookings.com to process all Personal Information about you and the persons named on the booking that has been obtained in connection with your booking. Personal information shall be deemed to include, but not be limited to: any telephone numbers; fax numbers; email addresses; addresses of residences; signatures; ID or passport copies; or any other information belonging to you or your group.

The Personal Information that StMartinbookings.com collects shall be obtained, processed, and transmitted in compliance with European Directives 95/46 and 2002/58, as well as any other such legislation that substitutes, complements and develops it. Before you travel

StMartinbookings.com is not liable for damages or losses that may result from travel to any particular destination. The Government of your country may help travellers stay safe overseas. Check with your government for the latest advice on conditions and general information concerning specific countries.

It is your responsibility to ensure that you have the relevant travel and health documents before departure for the country you are visiting, which shall include, but is not limited to, any inoculations that may be required, identification, passport and entry visa(s). StMartinbookings.com shall not be liable for any expense incurred resulting from your missing, incomplete or incorrect documentation or any non-compliance with requirements.

Insurance

You are strongly advised to take out adequate travel insurance prior to arriving at your destination. It is your responsibility to check you have adequate insurance cover. The insurance should cover, amongst other things, the cost of cancellation by you, personal losses, all medical costs and the costs of assistance including return to your country of residence in the event of an accident or illness.

Force Majeure

StMartinbookings.com will not be liable for any changes, cancellation, effect on your booking, loss or damage suffered by you or for any failure by the accommodation or other service providers and/or StMartinbookings.com to perform or properly perform any of our respective obligations to you which is due to any event(s) or circumstance(s) if the non-performance is caused by force majeure. By way of example force majeure includes, but is not limited to, war, revolution, terrorist act, closure of borders, epidemic, natural catastrophe or other causes that seriously affect both parties and other unforeseeable causes beyond StMartinbookings.com's control.

Complaints or issues with your accommodation

In the unlikely event that you have reason to complain or experience any problems with your accommodation or other service provider please inform their staff or management immediately, to enable them to take appropriate action. Please also contact StMartinbookings.com with the details; any company receiving multiple legitimate complaints will be removed from StMartinbookings.com

Currency rates are based on various publicly available sources and are only updated daily; as such they cannot be guaranteed as completely accurate and should be used as guidelines only. Actual rates may vary and you may wish to verify these with a qualified professional.

Legislation and Courts of Jurisdiction

This agreement will be governed by Dutch law and any disputes will be dealt with by the Dutch courts.
